They wanted to talk to him and get a statement so that they would know the extent of his injuries and what happened. He wanted to know if I thought that was a good idea. My response to that is the same response that I would give in any context involving an insurance claim or personal injury claim— no, you do not have any responsibility or duty to speak to the insurance carrier or the lawyer for the person who actually caused your injuries. You have no responsibility to them whatsoever.
Rarely or never can there be anything good that’s going to come from you giving any type of statement to an insurance carrier or to an attorney. That statement is not for your benefit. That statement is for the benefit of the insurance carrier and for the company itself. I would say that anyone who’s been injured in any type of bus accident needs to go ahead and find a trial attorney who has experience in handling bus accidents to represent them, so that that attorney can speak to the insurance company on their behalf.
