|What if the dog owner doesn't have insurance?|
I recently spoke to someone from North Augusta who was attacked by a dog, and the owner of the dog did not have insurance. This person wanted to know what they should do and if they still had a claim. The answer to that is, yes, you do have a claim. You have a claim regardless of whether there is insurance to cover the event or not. It does make it more difficult, because you are limited to going after that person’s assets. You are limited in your ability to be able to collect directly from that person; in that case, it really depends on the type of assets that that person has.
I think that, in any event, it is very important to go ahead and, if you have been the victim of a dog bite, to go ahead and hire an attorney early in the process. That way, that attorney can go ahead and take a look at the facts of the case and give you a realistic idea of what you may be able to recover.
