|How long does it take to resolve a bus accident case?|
I recently spoke to a man in North Augusta who was injured in a bus accident, and his first question was, “How long does the process take?” My response to that is my response to similar questions in all context, which is it really depends on a couple of different factors.
First, it mainly depends, from the standpoint of the attorney, on how badly the client is injured. You don’t want to move too fast in trying to settle a case. You want to make sure, as a person who’s been injured, that you get the medical treatment that you need, that you get better, that no one is rushing you in your medical treatment, and that you reach what they call maximum medical improvement,a term that just means you’ve gotten either back to your pre-wreck level of health or that the doctors have done all they can, but you’re always going to have an impairment. You don’t want to try to settle your case before you get to maximum medical improvement because that’s when you determine what your real damages really are. Before that, you’re not really sure; you don’t know what’s going to happen in the future. That is one of the most important things – waiting until the person gets to maximum medical improvement.
The other main factor is how reasonable the insurance company is. Are you dealing with an insurance company that is reasonable and wants to adequately compensate the person who’s been injured as a result of their insured’s negligence, or are you dealing with a more unreasonable insurance company that’s going to necessitate litigation? In any event, I would urge anyone to find an experienced lawyer, a trial attorney who has experience in bus accident cases, and one who will prosecute your case vigorously, and one who will see your case all the way through to a jury trial, if necessary. If anyone out there has been the victim in a bus accident, please give us a call. We’d be more than happy to answer any questions you have.
