Question:

Is workers' compensation my only option following an on-the-job injury?

Answer:

I had a client call me recently who had been injured by the actions of a subcontractor at their workplace. My client asked me if they were able to make a claim against this subcontractor for their negligence, or if they were only limited to workers’ compensation from their employer. If you’re reading this, you may have similar questions. I’ll explain to you what I explained to my client.

Is Workers' Compensation My Only Option?

You cannot sue your direct employer for your injuries and damages in circuit court in South Carolina. You’re limited to workers’ compensation against your employer. If there is another company responsible for your injuries, however, then you’re able to sue that company for unlimited damages in circuit court. You’re allowed to sue them for pain and suffering, mental anguish.
